When separation or divorce has taken place it is apparent in many cases that when one parent has interim, joint or sole custody, the parent frequently denies access to the other.

This normally occurs when the parent does not drop off the children for access or is not at home when the other parent arrives to pick up the children for access.

Another form of denial is termed “over holding the children,” for example, returning the children late, at times by hours and at times for an entire night.

Obviously the custodial parent becomes worried and concerned unless advised of the late return of the children. Denial of access or over holding is almost invariably more frequent at or during holidays and also when the parents live in different cities.

From a legal point of view, the options for dealing with this tactic are rather limited as follows:
1. Lawyers usually can’t do anything immediately because access changeovers often occur on or near weekends. Even if one lawyer manages to reach the other parent’s lawyer, chances are the other parent is not just denying access, but also avoiding their lawyer’s telephone calls.

2. The police generally won’t help you. Normally the reason is that your agreement or court order isn’t specific enough. For example, if you have access every second weekend, it usually is unclear whether this is your access weekend or not.

But even if your agreement or court order is specific, it is rare that the police will want to get involved unless there is a specific order in the court order that states the police are to intervene in such cases.

Thus the police will usually advise you to speak with your lawyer. It’s extremely frustrating and aggravating for the parent who is to have the children as well as it is for the children. The time with and plans you made with your children are ruined without any notice.

What to do? The following are suggestions:
a. Don’t lose your temper and try to remain calm. If this is the first time it has happened, there may well be legitimate reasons why the other parent is delayed.
b. If you have the opportunity, go to court on an urgent basis to get an order directing the police to enforce the visitation order. This is a good option for a longer access periods, for example, if the children were to spend their spring break with you.
c. Keep trying to pick up your children. If you’re supposed to be spending a specific time period with your children, there’s nothing wrong with going to the other parent’s home many times to try to pick up your children.
Even if the other parent is the one who is supposed to drop the children off at your home, it may make sense for you to try to pick up your children.
d. Document everything. A stern letter should immediately be sent to the other parent or their lawyer. Such letters are normally not answered but they should be sent. A paper trail is created so that in the future you can show the other parent’s pattern of access denial.
e. Demand make up time but this is usually feasible. Make up time is probably what’s best for the children but obviously the other parent does not think so.
f. If a parent is persistently late returning the children, go to court to get the changeover time modified to an earlier time. Also, consider picking up the children yourself rather than relying on the other parent.
g. If your case hasn’t been resolved yet (i.e. you only have a temporary or interim order for access), use the denials of access to build a case as to why you should get sole custody.
One factor courts consider in awarding custody is the willingness of each parent to facilitate access to the child by the other parent.
h. The last resort for dealing with persistent denial of access is to bring a contempt motion before the courts. There are difficulties in proceeding this way, but if the other parent is persistent in denying access you have no choice.

The keyword is persistent-it generally is not worth going to court about an occasional missed access period. Access denial is more common than a lot of people would care to admit.

It’s causes range from everything from that legal grey area immediately upon separation where there is no agreement or court order in place to cases where the court order in and of itself is vague and open to interpretation.

A good strategy would be to focus on building a trail of evidence to show the steps a parent takes to respond to access denial in a peaceful and non-adversarial manner.

It’s also good to be proactive.If a person has experienced access denial in the past or if access denial is a legitimate prospect, try sending your spouse advanced notice of your intention to access the children, usually via registered mail in high conflict cases, via email in moderate to low conflict cases.

If the access denial still occurs, send your spouse a registered letter asking to resolve the issue via family mediation and list the names of some mediators.

Encourage him/her to select one of the mediators, arrange for the appointment and offer to make yourself available. Give it a week for a response.

If there is no response, or your spouse tells you to “pound salt”, now you have a small trail of evidence to show a judge the steps you took in resolving the conflict.

It also shows the contrast between the parents who are mired in divorce conflict versus the parent who is looking for ways to resolve conflict.

Rushing off to court, or even just sending nasty letters between lawyers, which is the instinct of most divorce lawyers and litigants, will generally just serve to heighten tension which may well result in future denials of access.

How do I find the right divorce lawyer for my case?Do not just pick the first lawyer you find in the Yellow Pages and do not hire your cousin the tax specialist.

Jenny advises you build a list of lawyers who specialize in family law, also called matrimonial lawyers. Ask divorced friends and their former spouses for their opinions on who had the better lawyer, and get his or her name. Narrow down your list to three and have consultations with each of them.

"You need to see if you can have a good-working rapport with this person," she say. "You are in this for the long haul and you need to be able to trust the lawyer you choose."Can we get divorced without going to court?"

Smart divorces" don't usually end up in court. Jenny states that the many non combative ways to dissolve your marriage, including do-it-yourself divorces, mediation by an impartial third party, arbitration in front of a retired judge or senior lawyer, and collaborative law, in which lawyers work together toward settlement may have some merit."

Most lawyers know what the financial outcomes of most divorce cases will be, and that this outcome will be roughly the same no matter what form of resolution is used," says Jenny.

"The emotional impact of each process, though, is significantly different." “Emotions, too, are factors in helping it all happen faster (although couples are required to live separately and apart for one year before getting divorced -- they can live in the same house but not share the same bed)."

The quickest divorces are those in which both parties are able to work out child custody and financial support issues amicably.

WHAT YOU NEED TO KNOW IF DIVORCE THREATENS:
Divorce lawyers are very aware about the fact that the end of a relationship-marriage and common law partnerships can be stressful to the extreme.

There are no fixed hourly fees for divorce lawyers-the fees usually depend on the experience and knowledge. Lawyers with extensive and successful experience and knowledge invariably charge higher fees than other lawyers with less experience.

Fees may range from perhaps $200.00 hourly to $750.00 hourly or more and all involved in divorce usually obtain the quality of service and experience they pay for. Seeking bargain rates are also fraught with risk and can end up costing more than lawyers who charge higher fees.

There are individuals who choose to handle their divorces and again a caveat-beware of bargain or do it yourself kits.

Divorce applications are heard in federally appointed courts and not in Toronto family courts although the courts for divorce are located in a number of areas of Toronto.

Lawyers will advise clients they must file a divorce petition with the Clerk of the Court. It is usually best that the Petition for Divorce is served by a professional process server and not by one of the parties to the divorces so that the served party receives a copy personally.

In certain cases a court order must be obtained allowing service to be made in other ways. If you have not seen your spouse for a period of time, contact a lawyer.

The petition and other documents will be filed with the Court house and your lawyer may make an application to a judge for directions about what to do next.Your affidavit will prove that you tried to find and have your spouse properly.

Lawyers may wait for a short period of time before acting, as a precaution.If you are married, on a breakup of your relationship there is a presumption that each spouse in entitled to half of the matrimonial assets.

Not all assets owned by the spouses, however, are matrimonial assets. Assets not used in the marriage may be excluded from the division of property and your lawyer will explain this to you.

Matrimonial assets, especially the matrimonial home are divided equally between the spouses. However the judge has the power to award an unequal division of assets in certain circumstances.

Your lawyer will advise that the assets may be divided unequally in order to promote the self-sufficiency of one of the spouses, or an unequal division favoring the spouse that brought the asset to the marriage.

Your lawyer can give valid legal advice on how best to achieve the division of property he/she believes fair and proper following the breakup of a marriage.

The Divorce Act only applies to legally married persons. It does not apply to common-law couples. Lawyers want you to be aware that it does not matter how long a couple has lived together in a common-law relationship they do not qualify under the Divorce Act.

HOW TO OVERCOME, WITH A VIEW TO SETTLE, PROBLEMS THAT OFTEN COME WITH DIVORCE!
They are not easy to overcome, yet they are the reason that many divorce cases become so acrimonious and difficult to resolve.

My preferred method for dealing with a lot of these roadblocks is to get a neutral experienced third party involved who can deal with the roadblock. In an amicable case, this can be a mediator, preferably one with great credentials.

Otherwise, this person normally is a judge. Although I like to try to keep cases out of court if possible, if there is a serious roadblock to settling your case, you’ll need to go to court, so for today I’ll just assume your case is a litigated one and the neutral third party is a judge.

One feature of the family court system which I support strongly, is early judicial intervention in a non-adversarial setting , the case conference.

Handled appropriately, the case conference can remove a lot of the obstacles I discussed and allow the parties or their lawyers to work towards a resolution of their case.

Here’s how a judge can help, particularly at a case or settlement conference:

THE OTHER LAWYER
An inexperienced lawyer. He or she may not be reasonable simply because they don’t know what a local judge will decide. However, a judge at a case or settlement conference can give an opinion as to what the judge would decide at trial.

Overly aggressive lawyers can be roadblocks. Family law judges really encourage reasonableness and aggressiveness often backfires in court. As well, an early victory at a motion can help in the case of an overly aggressive lawyer retained by the other party to the divorce.

UNREASONABLE CLIENTS
Although many clients don’t listen to their lawyers, generally clients listen to judges. An early case conference can allow a judge to give an opinion as to the strengths and weaknesses of each spouse’s case. If someone hears something from both their lawyer and a judge, normally they will-often begrudgingly, go along with it.

CHILD CUSTODY DISPUTES
Getting the Children’s Lawyer or a child custody assessor involved can be of great help both in terms of resolving the case, and in helping each party to see their strengths and weaknesses as a parent.

DELAY
Getting the matter in front of a judge as early as possible and getting orders as to a time line will help with this.

REVENGE
A judge can show a vindictive spouse the financial consequences and the consequences on the children of pursuing a path of revenge.

LEGALLY AIDED SPOUSES
An ongoing problem with legally aided spouses is that you negotiate an agreement and then at the last moment, the agreement is not signed. Having the negotiations occur in a formal setting in front of a judge can result in a court order instead.

Also, moving these sorts of cases through the legal system as quickly as possible seems to work well in minimizing wasted legal fees.Spouse not working. Your time in front of a judge is going to be limited - you’re lucky to get an entire hour.

So, the judge will just want to deal with the big issues and if the spouse who is not working has come up with a lot of trivial issues that do not need to be resolved, the judge will normally be blunt and point that out.Interference from family.

At a case conference or settlement conference, you can ask the judge to exclude everyone from the court room other than the parties and their lawyers. This will allow you to get the interfering family member or friend out of the decision making process.
Obviously what I wrote is not a magic bullet - if such a thing exists all divorce cases would be completed in weeks rather than in months.

However, judicial intervention in a non-adversarial setting through conferences can make a difference in many cases.

THE RIGHTS AND RESPONSIBILTIES OF UNWED FATHERS!
What are the rights and responsibilities an unwed father in with respect to his unborn children when he is no longer in a relationship with the mother.

Child Support Once a child is born, the father has an obligation to pay child support. The amount of child support is the same regardless of whether the parties were married or not or whether the child was expected or not or whether there was any fraud or deception.

Susan asks whether a man may be required to pay child support before the child is born to cover prenatal expenses. The answer is yes: section 34(1)(h) of ’s Family Law Act permits a court to order “payment of expenses in respect of a child’s prenatal care and birth”

Spousal Support
Married and Common Law Partners

In Ontario unmarried couples don’t have the right to spousal support unless they fall under the definition of “spouse.”

This means they must have lived together for three years or have been living in a relationship of some permanence and be the parents of a child.

In other provinces the time limit is different than the three years. However, in one case in Ontario, where a couple had only been dating 9 months - they lived separately and only slept together on weekends - an appellate judge ordered spousal support be paid to cover half of the prenatal costs the mother incurred.

The judge found that this was a marriage-like relationship and so the father fell within the definition of “spouse” under the Family Law Act. Right to Know About the Child

Jenny states quite correctly that if the mother doesn’t let the father know about the pregnancy, then the father doesn’t really have any parenting rights. There is no law to compel a mother to inform the father about a pregnancy.

Adoption
Jenny asks: “If the woman chooses to give the child up for adoption does the man not have a say - does he not have to sign away his parental rights at the same time?”

If the man doesn’t know about the child, obviously there’s not much he can do to prevent the adoption.

However, if the mother wants to give the child up for adoption and the father wants custody, the father would have a good chance of getting custody.

Abortion
A man can’t force the mother of this child to have an abortion. MiscellaneousThere have been some suits for fraud and other creative torts in cases with facts along the line of the “Roe v. Wade for men” case.

Damages claimed usually include the total amount of child support the father would be estimated to pay over the course of the child growing up. The lawyer retained will provide the details.

Conclusion
Avoid having sex is optimum but totally unrealistic and undesirable. But you should be aware that if a pregnancy occurs, your legal obligations are pretty close to what they’d be if you were married.

WHAT TO DO AND HOW TO ACT WHEN YOU ARE QUESTIONED UNDER OATH –THE EXAMINATION FOR DISCOVERY!
In what was previously known as an examination for discovery is also called questioning.

Tips how to succeed at your questioning:
1. Give Precise Answers. If you’re asked how much you earned last year, give a dollar figure. Don’t explain why it was higher or lower than usual, or that it included a bonus. If someone is holding a pen and you’re asked “Do you know what this is?” the correct answer is “yes” not “a pen.”
2. Tell the Truth. Don’t try to outsmart your spouse’s lawyer. Not that your spouse’s lawyer is smarter than you, but they’ve been through this a lot more than you have.
3. Prepare in Advance.
Ideally you’d review every document that has been produced in your case. At a minimum, you should be familiar with your financial statement and all the pleadings. Take the time to have your lawyer do a mock questioning of you.
4. Anything You Say Can and Will Be Used Against You. Remember that your questioning can only be used by your spouse’s lawyer to help your spouse’s case. Your lawyer can’t use your questioning to help you. So, don’t worry about trying to argue your case. Just answer the questions you’re asked.
5. “I Don’t Remember” is a Dangerous Answer .
Think long and hard before you answer a question with “I don’t remember” (or even “I don’t know”).
The problem is that you can be sure your spouse will have a vivid memory of everything you forget. Even if what your spouse says is completely made up, you’ll have a hard time convincing a judge otherwise, because you’ve already sworn that you don’t remember.
6. You’re Not Stupid.
Often a lawyer will use unfamiliar terms, sometimes purposefully to confuse you, but oftentimes simply out of habit.

If you don’t understand what you’ve been asked, get it clarified. No one will think less of you if you do this, and you may be saving yourself from answering the wrong question.

7. Your Lawyer Can Only Help So Much.
Your lawyer’s role is mainly to ensure that you’re not asked inappropriate questions. So, there may be large periods of time when all your lawyer seems to do is sit there and listen.
8. Don’t Answer Until the Question is Asked.
In normal speech, we often start talking once we know what the other person is going to say. At questioning this is a problem, as a reporter will need to write down what two people are saying at once.

It’s a good idea to speak loudly and clearly as well so that the reporter correctly records what you say. Will you still be stressed even if you do all the above? Yes, and you probably won’t sleep well the night before, and after your questioning you’ll probably think of all sorts of better answers you could have given.

That’s normal and happens to everyone. But if you keep these tips in mind, your questioning will go a lot more smoothly.

DISCLOSURES REQUIRED BY NEWLY WEDS OR LIVING COMMON LAW!
One area of family law in which there tends to be a lot of misunderstanding is the effect of new partners on a person’s child support and spousal support obligations.

That is, if you start living with someone else, will that affect how much child or spousal support you must pay?

Today, I’ll just deal with one small part of that, namely what sort of disclosure must you give about your new partner’s income?

Cynically, I suppose the answer is nothing. You can just claim that you don’t know what your new partner’s financial situation is. In that case however, you’re risking two things.

First, if your new partner’s financial situation remains undisclosed, then a judge is likely to make a negative inference about this.For instance, if you are claiming undue hardship, the judge may assume that there is no undue hardship because of your new partner’s income.

Second, you risk dragging your new partner into the legal proceedings. Your ex may be more than happy to serve motion materials on your new partner asking for this financial disclosure directly.

So what should you disclose? It really depends on what your case is about. But at a bare minimum, you’ll normally be required to produce information about your new partner’s place of employment, earnings and contribution to household expenses.
This is what is required by the family law rules in cases where support is in issue.

As support for these figures, your new partner may be required to produce complete income tax returns and notices of assessment for the last 3 years.

There have been a few cases where more detailed financial disclosure has been required of new partners, and even cases where a new partner has been cross-examined under oath regarding their financial situation.

However, these are generally more complex cases and you’ll need to consult with a lawyer about further financial disclosure.

The general rule in family law is that almost anything that’s relevant needs to be disclosed - and judges tend to interpret disclosure requirements quite broadly.
Of course if your ex is just on a fishing expedition, you’ll want to defend against that vigorously.

THE QUALITY OF EVIDENCE IN DIVORCE CASES!
In family law cases, decisions depend greatly upon the quality of the information and evidence before the court. Often the law is simple - for instance, for anything relating to children, the test is what is in their best interests.

Or, the law is vague - for instance, for spousal support the court considers: Your assets and your spouse’s assets. Your income and your spouse’s income, your age and your spouse’s age. Your health and your spouse’s health The standard of living when you lived with your spouse.

The ability of your spouse to become self-sufficient: The contribution your spouse has made to your career. The economic hardship suffered by your spouse arising from the marriage If that’s not vague, try and figure out how much spousal support you need to pay based on that!

NON RECURRING INCOME!
Most people involved in a family law case in know that the amount of spousal support or child support that must be paid is based on income.However, income for family law purposes is not the same as income for income tax purposes.

The question that often arises is what is income for family law purposes. Often people receive income in a year that they don’t normally receive - this is known as non-recurring income. Should this be considered as income for purposes of calculating child support or spousal support?The answer is, as always, it depends on the facts of your case.

The Child Support Guidelines give judges discretion to decide whether to include or exclude one-off payments in income. However, over time, certain patterns emerge in judges’ decisions. While they are not “rules” they can provide guidance as to your particular case.

There is a bias in the courts towards including non-recurring income in income for child support and spousal support purposes.

The philosophy behind this is that if you can pay more support, you should be required to do so, as this is what’s best for the children.

There’s also another guiding principle in the courts, which is that a child’s standard of living should be about the same at each parent’s household.Some of the most common types of non-recurring income that courts deal with are:

1. RRSP Redemption.
Even though RRSP redemptions are included in your income for tax purposes, a one-off RRSP redemption normally would not be considered part of your income for child support or spousal support purposes.

However, if you had a pattern of cashing in a certain amount of RRSPs each year, the results might be different.

2. Stock Options. The law about including stock options in income is less clear. If you exercise stock options on a regular basis, the chances are that they will be included in your income.

However, if you exercise stock options only once, and this is not part of your normal pattern of income, there are leading cases that say this should be included in income and also that say this should not be included in income.

If you have a significant amount of one-off income from stock options, get a good family law lawyer and be prepared to roll the dice.

3. Severance Packages.
These are normally included in income for support purposes, even if you find a job right away and so have an unusually high income in the year the severance package was paid.

4. Personal Injury Awards.
Generally, if the damages you receive in a personal injury award are for pain and suffering, this does not need to be included in your income for purposes of calculating support.

If the damages you receive are for loss of income, these generally do get included in income for support purposes. If you’re negotiating an out of court settlement of your personal injury suit, you can guess how you want the settlement to read.

5. Capital Gains.
The treatment of this type of income is all over the map, but generally one-off capital gains are considered income for purposes of calculating support. On the other hand, generally one-off capital losses are not used to reduce income for purposes of calculating support.

The most usual case where capital gains will not be included in income is where the gains are immediately re-invested.

For instance, if you sell a business, and re-invest the proceeds into a new business, then generally the capital gains from the sale of your business won’t be considered as part of your income for purposes of calculating child support and spousal support.

Don't Play the Waiting Game.

NOTHING STOPPED HIM- BECAUSE OF HIS INGRAINED REFUSAL TO EVER GIVE UP- HIS STUBBORNESS AND PERSISTENCE WAS AND IS LEGION.

AS HE EXPECTED HE OVERCAME THE MOST DIFFICULT HURDLES AND BECAME A LAWYER WITH FLYING COLOURS, OPENED HIS LAW OFFICES AND BEGAN TO PRACTICE LAW AS A SOLE PRACTITIONER.

HIS PRACTICE QUICKLY GREW BY LEAPS AND BOUNDS BECAUSE OF HIS KNOWLEDGE, SKILLS, ABILITIES AND A HOST OF OTHER REASONS INCLUDING THE MEANS AND WAYS HE CREATED TO OBTAIN CLIENTS.
HE OBTAINED THEM MUCH FASTER THAN EVEN HE THOUGHT POSSIBLE!

HE GRADUATED AS A LAWYER WHEN HE WAS BUT 22YEARS OLD, THE YOUNGEST LAWYER BY FAR AND HE PRACTICED AS A SOLE PRACTITIONER.

THREE YEARS AFTER HE STARTED HIS PRACTICE HE WAS EARNING SUFFICIENT MONEY TO LOOK AFTER HIS FAMILY REASONABLY WELL.

HE THEN APPLIED TO MEDICAL SCHOOL SO THAT HE COULD PRACTICE AS A MEDICO-LEGAL EXPERT BUT HE WAS REJECTED FOR OBLIQUE REASONS INCLUDING HIS RELIGION-HE IS JEWISH.

ONE OF THE OTHER OBLIQUE REASONS WAS THAT THE DEAN OF MEDICINE SAID TO HIM WITHOUT QUALMS-

“YOU DON’T KNOW THE REALITIES OF LIFE. ALL YOU HAVE DONE WAS SIT ON YOUR BEHIND, MAKE MONEY AND BABIES WHEREAS I HAVE BEEN A SOLDIER AND KNOW WHAT THE REALITIES ARE."

FURTHERMORE, HE SAID “JEWS MUST NEVER BECOME DOCTORS-THEY ARE INDIVUALISTS AND DOCTORS ARE CONFORMISTS.

THEREFORE NO JEWS SHOULD EVER BE DOCTORS. WHATS MORE, DON’T APPLY-I WILL MAKE SURE THAT YOU WILL NOT BE ACCEPTED.”THE DEAN WAS A NOTED AND VOCIFEROUS ANTISEMITE.

ALL OF THE AFORESAID INSULTS WERE HURLED AT ME BY THE DEAN OF MEDICINE- AND THEY WERE ONLY SOME OF THE MANY DISCRIMINATING AND BIASED STATEMENTS HE MADE.

I WAS DUMBFOUNDED TO SAY THE LEAST AND I FELT MY ANGER AND TEMPER GROWING.

HAD I NOT CONTROLLED MYSELF THE INTERVIEW WOULD HAVE ENDED QUITE DIFFERENTLY.

MR. SOLNIK BECAME EXTREMELY ANGRY BECAUSE OF THE REJECTION AND THE MANY VILE AND DISCRIMINATORY STATEMENTS HURLED AT HIM BY THE DEAN.

LATER THAT DAY HE REFLECTED ON THE REMARK AND ASKED HIMSELF “WHAT DO I KNOW OF THE REALITIES OF LIFE?”

HAVING BEEN BROUGHT UP IN TORONTO WHERE HE WAS BORN HE SUDDENLY REALIZED THAT HE KNEW NOTHING ABOUT THE TRUE REALITIES OF LIFE AND HE DECIDED TO REMEDY THIS AS QUICKLY AS HE COULD.

HE WAS RAISED BY HIS PARENTS AND GRANDPARENTS-BOTH HIS FATHER AND GRANDFATHER WITH WHOM HE LIVED, WERE WORKING MEN AND MADE BARELY ENOUGH TO HOUSE, FEED, EDUCATE AND CLOTH THE LARGE FAMILY-IRVING HAD FOUR SIBLINGS.

WHEN HE WAS 16 YEARS OLD HIS FATHER DIED SUDDENLY OF A MAJOR CORONARY AND HE BECAME THE SOLE SUPPORT OF HIS FOUR YOUNGER SIBLINGS, HIS MOTHER AND HIS GRANDFATHER.

HIS SADDNESS, ANGER AND DISAPPOINMENT THAT HE WAS NOT ACCEPTED INTO MEDICAL SCHOOL WAS BEYOND DESCRIPTION NOTWITHSTANDING HIS REALIZATION THAT HE KNEW TRULY NOTHING ABOUT THE REALITIES OF LIFE.

SHORTLY AFTER HIS REJECTION BY THE DEAN HIS ATTENTION WAS CAUGHT BY AN ARTICLE IN THE NEWSPAPER OF A WAR, FIGHTING AND MASSACRES OF CIVILIANS IN THE CONGO AND ELSEWHERE IN AFRICA.
HE MADE UP HIS MIND-HE DECIDED TO LEARN ABOUT THE REALITIES OF LIFE AND WITHIN THREE WEEKS HE WAS IN THE CONGO.

HE HAD LEARNED ABOUT AN UNOFFICAL ENTITY THAT DID NOT EXIST ON PAPER AND THAT WAS CREATED BY SOUTH AFRICA TO LOOK AFTER ITS INTERESTS IN THE CONGO AND ANGOLA-THE 5TH COMMANDO.
HE LEARNED AFTER HE WAS ACCEPTED AS A COMBATANT THAT THE “ENTITY”-THE 5TH COMMANDO WAS A MERCENARY FORCE AND MOST OF THE MERCENARIES HAD EXTENSIVE EXPERIENCE IN WAR AS SOLDIERS WHEREAS HE HAD NONE.

BY USING ALL HIS WITS, GUILE, WILES, STUBBORNESS, TENACIOUS PERSISTENCE AND TOTAL FEARLESSNESS IRVING SOLNIK WAS ACCEPTED AS A COMBATANT
ALTHOUGH HE KNEW NOTHING ABOUT SOLDIERING, GUNS, STRATEGIES, TACTICS, WAR, KILLING OR ANYTHING RELATED TO WARFARE.

IRVING SOLNIK MET THE COLONEL-COLONEL McHORE WHO COMMANDED THE 5th COMMANDO AND SAID HE WANTED TO JOIN IT.

AFTER A FEW GENERAL QUESTIONS THE COLONEL TOLD IRVING “TO GET THE HELL OUT OF HERE, NOW!”

HE SAID “NO.” THE COLONEL THEN TOOK HIS 45 CALIBER AUTOMATIC PISTOL FROM ITS HOLSTER AND IRVING STILL SAID “NO.”

THE COLONEL RAISED HIS PISTOL AND IRVING SAID “SHOOT-I DARE YOU TO-I AM NOT AFRAID!”

THE COLONEL LOOK AT IRVING AS IF HE WAS A LUNATIC AND SAID “YOU’RE A STUBBORN LITTLE BUGGER ARE’NT YOU?

IRVING SAID “THERE ARE NONE AS STUBBORN AND AS PERSISTENCE AS I AM.”

THEN AFTER MUCH PERSUASION BY IRVING AND BECAUSE HIS STUBBORNESS-HE WOULD NOT TAKE NO FOR AN ANSWER BECAUSE OF WHAT HE IS, THE COLONEL DECIDED TO ACCEPT HIM PROVIDED HE COULD SURVIVE FOR THREE DAYS WHEN HE WAS TO BE TESTED BY THE COLONEL’S TOUGHEST ADJUTANT.

SOMEHOW IRVING SURVIVED TESTS OF PHYSICAL AND MENTAL ENDURANCE THAT VERY FEW COULD.

“AS I FOUND OUT QUICKLY FOUND OUT THE TESTS WERE SHEER PHYSICAL AND MENTAL TORTURE AND MOST WHO TRIED TO ENDURE THEM FAILED MISERABLY.”

I HAVE NO IDEA WHY AND HOW I ENDURED THEM AND SURVIVED. PERHAPS MY REFUSAL TO EVER GIVE UP, MY TENACIOUS PERSISTENCE AND SHEER STUBBORNESS WERE FACTORS IN MY SURVIVAL.

“WHEN I LAY DOWN AT NIGHT TO TRY AND SLEEP I SAID THE JEWISH PRAYER FOR THE DEAD BECAUSE I DID NOT BELIEVE I WOULD AWAKEN.”

IRVING SOLNIK WAS PUT THROUGH THE SEVEREST OF TESTS THAT HE SOMEHOW SURVIVED AND THREE DAYS LATER HE WAS ACCEPTED AS A COMBATANT AND IN DUE COURSE WAS APPOINTED THE MEDICAL OFFICER OF THE UNIT ALTHOUGH THEN HE NEW NOTHING ABOUT MEDICINE.

BUT HE HAD GUTS AND FAITH IN HIMSELF, REMEMBERING WHAT HE LEARNED FROM MANY YEARS OF STUDYING THE KABALLAH-“THE MASTER AWAITS THE STUDENT.”

Before being appointed the medical officer-MO-for the troop he was promoted to an intelligence officer because of his inate ability to quickly become fluent in many languages and dialects, having become fluent in the dialect of the enemy.

His function was to obtain as much intelligence as was possible and as quickly as possible. His new appointment was obviously a very high risk appointment because he had to be very near the enemy troops and at times mingle with them disguised to minimize the chance of his being found out and caught-as a spy-then tortured and killed.

He successfully discharged his duties and functions as an intel officer for about 12 months and had collected Intel info that was invaluable.

Shortly thereafter because of certain happenings he was appointed a paramedic and after a period of time during which he proved himself and his abilities he was promoted to MO-medical officer for the entire 5th Commando.

HE WAS REQUIRED TO PERFORM BATTLEFIELD SURGERIES OF WHICH HE KNEW NOTHING BUT HE QUICKLY LEARNED.
HE RECALLED WHAT WAS WRITTEN IN THE KABALLAH-JEWISH MYSTICISM-

“THE MASTER AWAITS THE STUDENT.”
AND IRVING WAS AN APT STUDENT AND SUDDENLY IRVING KNEW WHAT TO DO. THE MASTER CAME TO AND TAUGHT HIM EVERY NIGHT AT PRECISELY MIDNIGHT.

ALL THE MEN IRVING TREATED SURVIVED-HOW HE CANT EXPLAIN HOW AND WHY EXCEPT FOR THE MASTER’S ARRIVAL TO TEACH HIM.

IN ITSELF WHAT IRVING DID IS THE STUFF OF LEGENDS AND HE COULD WRITE EXTENSIVELY ABOUT WHAT TOOK PLACE AND WHAT HE HAD NO CHOICE BUT TO CARRY OUT AS BEST AS HE COULD.

How I became para-medic and MO is fascinating and revealing story in itself.

“On the day when I was accepted as a combatant, I was told to rest because of the tests I endured and to meet other enlisted men.”

I wandered through the camp grounds and passed a hut from which the most horrific screams emanated. I was about 30 feet from the hut when pieces of flesh, fingers, arms, legs and other body parts flew through openings in the hut-there were no glass windows.

I watched what was happening and my mind could not grasp what was taking place. I was paralyzed and stood rooted to the ground where I stood.

After what seemed many hours I finally was able to remove myself from the horror I witnessed. Shortly after I met another enlisted man and asked if he knew what was taking place in the hut.

He said it was the interrogation hut where prisoners were questioned but said nothing else except to give me some advice.

“Don’t ask questions of anyone-all you need to know are the given names of other members of the troop and nothing else, if you know what is good for you.” Then he quickly walked away.

It took me several days to recover from what I had seen and then I met an officer of the 5th Commando and asked him what was taking place in the interrogation hut.

He was reluctant to say anything but I persisted and he finally opened up and told me what I wanted, was almost afraid to know.

He said “the hut was where prisoners were interrogated and none ever left alive and invariably all that remained of them were pieces of their bodies that were hurled into the jungles for the animals to gorge themselves.

The interrogator was a man named Peter Schramm, a former guard and interrogator/torturer at Auschwitz-the infamous concentration camp where millions of men, women and children perished in ways that defy imagination and belief.

Schramm was a Nazi and a vile psychopath who enjoyed his work immensely.”

“Stay away from the hut and Schramm, if for no other reason because you are a Jew and Schramm is a notorious Jew hater who will kill you at the first chance he gets.”

Then the officer walked away and I was alone again trying desperately trying to comprehend all that I had heard and seen.

Several days later I was ordered to take part in a patrol that was to reconnoiter certain areas of the jungle because the enemy was allegedly camped in the areas we were to reconnoiter.

We left camp in an armored vehicle-a type of truck-that I was not familiar with but it held all of us and a barrel of oil, for what purposes I knew not nor did I ask.

The patrol-18 men in all-was headed by the notorious Peter Schramm and I could barely believe he was a psychopath and murderer-he seemed to be an ordinary quiet spoken man as he gave orders and instructions.

To believe that he was evil personified was difficult to comprehend and rationalize.

Instead of appointing one of the patrol as a scout Schramm took point-far in front of the rest of us and out of our sight.

Then we saw him running quickly towards us. As he did so heavy fire from small arms and machine guns from behind a secluded stand of trees was upon us.

Then hand grenades were heaved at us as well but we were relatively safe for the moment, having regrouped behind huge 200-300 feet high trees.

We could see the clearing we had just left and saw Schramm running to us when suddenly a hand grenade exploded very close to him and it was quite easy to see that he had fallen and that his right leg from about the knee down was gone-blown to smithereens.

Something unexplainable then happened to me. I felt that I was invaded by what I did not know and I felt that I had two heads. One was mine and the other one seemed to take control of all my actions.

Suddenly my voice bellowed “cover me-I’m going to get Schramm!”

All the men thought I was crazy and once I heard “that idiot kike” and once “the crazy yid.”They shouted-“The bastard is probably dead and if he isn’t let him die. You know what he is and what he does.”

I shouted back “cover me!” I then ran through a hail of bullets much thicker than a swarm of jungle mosquitoes and managed to get to Schramm. I should have had more holes in me than Swiss cheese but I had nary a scratch which was impossible but fact.

I lifted Schramm up and although he weighed well over 200 pounds (I was about 140) I felt as if he weighed nothing as I swung him over my shoulders and headed back behind the tree line where my men were.

The enemy guns stopped firing for several minutes-they could not believe what was happening or what I was doing.

Suddenly the guns began to chatter again as I ran with Schramm and within minutes I was behind the tree line-safe for the moment.

There was total silence from my comrades who still were in shock because of my actions.

Suddenly my voiced boomed out again “Get me belts, ropes, anything from the truck and within minutes I had a tourniquet tightened about two inches above Schramm’s knee.

Then my voice boomed out again-Get me anything sharp, knives, saws, bayonets, anything and they found two rusty old hack saws.

I ordered two men to take turns cutting off the remainder of his leg several inches above the knee until there was a raw stump. It took well over two hours but how he survived the surgery was left unanswered.

Schramm should have been dead by them from shock-loss of blood and body fluids but he was still alive-barely. My voiced boomed out again

“Get the oil from the truck and boil it in its barrel, now!”

As soon as the oil was boiling my voice bellowed “Pick him up and put the stump of his leg in the boiling oil” and they did so for several minutes-I had lost all sense of time.

Schramm fortunately was unconscious during the various procedures but his vital signs indicated he was still alive. Very weak, but alive.

By then most of my men and I were totally exhausted but the adrenalin rush kept us going.
The men who did not assist me held the enemy at bay and then they counter attacked the enemy’s position.

The enemy retreated and the only explanation I can offer was that they must have thought that we were all supermen.

I stayed up virtually the entire night forcing water in small doses into Schramm and by morning he was awake but comatose.

Within about two weeks thereafter he was slowly hobbling around with a makeshift crutch from a tree branch.

What had happened? How did I know what to do and how to do it? Why did I risk my life and those of my comrades to save the life of a crazed murderer?

The answers for the first two questions were, as written in the Kaballah-“The Master Awaits The Student.”

It was the only answer that made any sense. But why did I save Schramm’s life? Again it is written in the Kabbalah-

“There is a reason for every act and although the reason may not be known at the time, it will be revealed in the fullness of time.”

It made no sense that this murderer should live but there so little we know and so much that we may never learn and know.
Several weeks later I encountered Schramm hobbling along and he approached me and asked why I saved his life?

I said “You are the most evil of evil beings but I saw your blood and knew then you had a soul.”

“I probably would have needed a telescope miles long to locate your soul if then.” Furthermore it is written in our Torah “that to save a life is akin to saving the universe.”

He then answered “You must have known that I knew you were a Jew and at the first chance I would have exterminated you as I did other Jews.” I then walked away and left him to his own devices.

I wondered if I would ever know why I saved Schramm’s life and found a partial answer several months later.

I was walking near the interrogation hut and Schramm was back as the interrogator but I saw no pieces of human bodies fly from the hut and heard no blood curdling screams.

Later I found out that Schramm, although the interrogator, again no longer killed or tortured prisoners-he beat them up often leaving some of them in terrible condition, but alive.

Was this the reason I saved him?

IN ALL I SPENT SOME SEVEN PLUS YEARS IN AFRICA AND SAVED COUNTLESS LIVES OF MEN, WOMEN AND CHILDREN AND THERE I LEARNED THE TRUE REALITIES OF LIFE.

HOW I LOST MY RIGHT EYE IN THE JUNGLES OF THE CONGO!

One day I was patrolling an area of the jungle near our bivouac and although it was mid afternoon, the day was as dark as a moonless and starless night. It was sheer impenetrable blackness.

Suddenly I felt a sharp pain in my right eye but because of the darkness I could not see without my flashlight. I then touched the right side of my face and it was sticky wet.

I took out my flashlight and pointed it at my hand and saw it was covered with blood and suddenly the pain in my head reached a crescendo-it was unbearable!

I then flashed the light at the trees and bushes near me and saw an eye lodged on a sharp thorn like branch of a bush and there was my right eye staring blindly back at me from its perch on a branch of a bush.

For several minutes I was in a state of shock and my mind could not grasp what had taken place. I had walked straight into the thorn like branch when I felt something in my eye and pulled my head backwards.

By so doing my eye was yanked from its socket and was perched on the bush as if it was the black bird perched on the bust of Pallas.

Dizzily and weak from shock and loss of blood I finally managed to return to our camp and sought medical attention where there was none-I was the MO.

I did what I could to staunch the flow of blood and finally partially did so. Then I put a rough bandage over the now empty socket and headed to my tent where I lay down and tried to sleep. I did so in fits and pondered my fate.

Being a Kabbalist I knew that there is a reason for everything but no matter how much I tried I could not find any conceivable reason for the loss of my eye in the manner it was lost.

I then began to doubt all that I had learned about Kaballah for many years and continued to doubt all that I had learned.

To lose an eye in such a manner was simply beyond belief and incomprehensible.

Some thirty years later I finally found the reason why my eye was torn from its socket.

One day back in Toronto I was asked by a client to look at a building for him in the most dangerous area of Toronto and I was not worried about it because I had my back belt, second degree, that I obtained from a great Sensei.

He taught me to avoid a fight if I could and if not to use the Karate skills in which I had been exceptionally well trained.

My sensei also taught me how to harness and control the immense powers of my subconscious mind.

I did not comprehend what my Sensei meant and asked him again. He simply repeated the words and yet I could not comprehend them.

With a degree of impatience he finally said that I would understand in time all that he told me without any conscious effort on my on my part.

In any event I went to see the property I have referred to for my client and suddenly as if from nowhere a man appeared.

He was one of the biggest men I ever had seen and the most powerful too and came-charging at me with a baseball bat raised high.

There was no place for me to run and I prepared for a fight that could easily result in my death or at least in serious injuries-such as a fractured skull and broken limbs.

I readied myself for a fight I had never previously encountered but was quite confident I would win the fight but I was equally certain that I would end up badly hurt-a fractured skull-broken limbs and possibly death.

But I had no choice! He suddenly raised the bat over his head with the intent of perhaps killing me.

Suddenly I felt that my body was taken over by some kind of entity that I had never experienced before.

As he raised his bat I pulled my reading glasses from my jacket pocket, broke of the two arms and jumped as high as I as a could into the air to face him-face to face.

As he was about to bring the bat down on me I was high in the air and facing him. I touched an area of my false eye-a prosthesis and in a millisecond my eye fell out of its socket to lie on the pavement under our feet.

Virtually simultaneously while high in the air, face to face with my opponent, I jabbed the sharp ends of my glasses towards his face-his eyes and shouted:

“See the hole in my head and if you’re not away from me in a second you will have two holes in your head.”

He quickly glanced at my empty eye socket, then at my prosthesis lying on the road and staring up at us.

He was a black man, one of the biggest I had ever seen and suddenly he turned whiter than I was or so it appeared.

He quickly dropped the bat and began running as fast as he could as if I was the devil-screaming the loudest he could.

The bat that fell out of his hand bounced up from the payment and bumped against my head giving a small bump-the full extent of my injuries.

Thus the reason for losing my eye in the Congo-it was lost to save me from death or serious injury some thirty years later.

The Kaballa was right-there is a reason for everything. I them took my prosthesis to my eye doctor who said it was cracked-a virtual impossibility until I told him all that transpired.

He then said-“this should be in “Believe It Or Not”-in all likelihood this is a record and a first-how an artificial eye saved me from death or serious injury.

Thereafter my and belief faith in the Kaballah was restored –the reason I lost my right eye to a thorn on a bush in the jungles of the Congo was to save my life years later.

HOW TO OVERCOME, WITH A VIEW TO SETTLE, PROBLEMS THAT OFTEN COME WITH DIVORCE!

They are not easy to overcome, yet they are the reason that many divorce cases become so acrimonious and difficult to resolve.

My preferred method for dealing with a lot of these roadblocks is to get a neutral experienced third party involved who can deal with the roadblock.

In an amicable case, this can be a mediator, preferably one with great credentials.

Otherwise, this person normally is a judge.Although I like to try to keep cases out of court if possible, if there is a serious roadblock to settling your case, you’ll need to go to court, so for today I’ll just assume your case is a litigated one and the neutral third party is a judge.

One feature of the family court system which I support strongly, is early judicial intervention in a non-adversarial setting , the case conference.

Handled appropriately, the case conference can remove a lot of the obstacles I discussed and allow the parties or their lawyers to work towards a resolution of their case.

CHILD CUSTODY DISPUTES.
Getting the Children’s Lawyer or a child custody assessor involved can be of great help both in terms of resolving the case, and in helping each party to see their strengths and weaknesses as a parent.

THE RIGHTS AND RESPONSIBILTIES OF UNWED FATHERS!
What are the rights and responsibilities an unwed father in with respect to his unborn children when he is no longer in a relationship with the mother.

Child Support Once a child is born, the father has an obligation to pay child support. The amount of child support is the same regardless of whether the parties were married or not or whether the child was expected or not or whether there was any fraud or deception.
Susan asks whether a man may be required to pay child support before the child is born to cover prenatal expenses.
The answer is yes: section 34(1)(h) of ’s Family Law Act permits a court to order “payment of expenses in respect of a child’s prenatal care and birth” .

Spousal Support-Married and Common Law PartnersIn Ontario.

Unmarried couples don’t have the right to spousal support unless of some they fall under the definition of “spouse.”

This means they must have lived together for three years or have been living in a relationship permanence and be the parents of a child. In other provinces the time limit is different than the three years.

However, in one case in Ontario, where a couple had only been dating 9 months - they lived separately and only slept together on weekends - an appellate judge ordered spousal support be paid to cover half of the prenatal costs the mother incurred.

The judge found that this was a marriage-like relationship and so the father fell within the definition of “spouse” under the Family Law Act.

Right to Know About the Child
Jenny states quite correctly that if the mother doesn’t let the father know about the pregnancy, then the father doesn’t really have any parenting rights. There is no law to compel a mother to inform the father about a pregnancy.

Adoption
Jenny asks: “If the woman chooses to give the child up for adoption does the man not have a say - does he not have to sign away his parental rights at the same time?”

If the man doesn’t know about the child, obviously there’s not much he can do to prevent the adoption.

However, if the mother wants to give the child up for adoption and the father wants custody, the father would have a good chance of getting custody. Abortion A man can’t force the mother of this child to have an abortion.

Miscellaneous
There have been some suits for fraud and other creative torts in cases with facts along the line of the “Roe v. Wade for men” case.

Damages claimed usually include the total amount of child support the father would be estimated to pay over the course of the child growing up. The lawyer retained will provide the details.
Conclusion Avoid having sex is optimum but totally unrealistic and undesirable. But you should be aware that if a pregnancy occurs, your legal obligations are pretty close to what they’d be if you were married.

WHAT TO DO AND HOW TO ACT WHEN YOU ARE QUESTIONED UNDER OATH –THE EXAMINATION FOR DISCOVERY !

In what was previously known as an examination for discovery is also called questioning.

How to succeed at your questioning:
1. Give Precise Answers .

If you’re asked how much you earned last year, give a dollar figure. Don’t explain why it was higher or lower than usual, or that it included a bonus. If someone is holding a pen and you’re asked “Do you know what this is?” the correct answer is “yes” not “a pen.”

2. Tell the Truth. Don’t try to outsmart your spouse’s lawyer. Not that your spouse’s lawyer is smarter than you, but they’ve been through this a lot more than you have.

3. Prepare in Advance.
Ideally you’d review every document that has been produced in your case. At a minimum, you should be familiar with your financial statement and all the pleadings. Take the time to have your lawyer do a mock questioning of you.

4. Anything You Say Can and Will Be Used Against You .
Remember that your questioning can only be used by your spouse’s lawyer to help your spouse’s case. Your lawyer can’t use your questioning to help you. So, don’t worry about trying to argue your case. Just answer the questions you’re asked.

5. “I Don’t Remember” is a Dangerous Answer . Think long and hard before you answer a question with “I don’t remember” (or even “I don’t know”). The problem is that you can be sure your spouse will have a vivid memory of everything you forget.

Even if what your spouse says is completely made up, you’ll have a hard time convincing a judge otherwise, because you’ve already sworn that you don’t remember.

6. You’re Not Stupid. Often a lawyer will use unfamiliar terms, sometimes purposefully to confuse you, but oftentimes simply out of habit. If you don’t understand what you’ve been asked, get it clarified. No one will think less of you if you do this, and you may be saving yourself from answering the wrong question.

7. Your Lawyer Can Only Help So Much. Your lawyer’s role is mainly to ensure that you’re not asked inappropriate questions. So, there may be large periods of time when all your lawyer seems to do is sit there and listen.

8. Don’t Answer Until the Question is Asked. In normal speech, we often start talking once we know what the other person is going to say.

At questioning this is a problem, as a reporter will need to write down what two people are saying at once. It’s a good idea to speak loudly and clearly as well so that the reporter correctly records what you say. Will you still be stressed even if you do all the above?

Yes, and you probably won’t sleep well the night before, and after your questioning you’ll probably think of all sorts of better answers you could have given. That’s normal and happens to everyone. But if you keep these tips in mind, your questioning will go a lot more smoothly.

DISCLOSURES REQUIRED BY NEWLY WEDS OR LIVING COMMON LAW!
One area of family law in which there tends to be a lot of misunderstanding is the effect of new partners on a person’s child support and spousal support obligations.

That is, if you start living with someone else, will that affect how much child or spousal support you must pay?

Today, I’ll just deal with one small part of that, namely what sort of disclosure must you give about your new partner’s income?

Cynically, I suppose the answer is nothing. You can just claim that you don’t know what your new partner’s financial situation is. In that case however, you’re risking two things.

First, if your new partner’s financial situation remains undisclosed, then a judge is likely to make a negative inference about this.For instance, if you are claiming undue hardship, the judge may assume that there is no undue hardship because of your new partner’s income.

Second, you risk dragging your new partner into the legal proceedings. Your ex may be more than happy to serve motion materials on your new partner asking for this financial disclosure directly.

So what should you disclose? It really depends on what your case is about. But at a bare minimum, you’ll normally be required to produce information about your new partner’s place of employment, earnings and contribution to household expenses.

This is what is required by the family law rules in cases where support is in issue. As support for these figures, your new partner may be required to produce complete income tax returns and notices of assessment for the last 3 years.

There have been a few cases where more detailed financial disclosure has been required of new partners, and even cases where a new partner has been cross-examined under oath regarding their financial situation.

However, these are generally more complex cases and you’ll need to consult with a lawyer about further financial disclosure.

The general rule in family law is that almost anything that’s relevant needs to be disclosed - and judges tend to interpret disclosure requirements quite broadly. Of course if your ex is just on a fishing expedition, you’ll want to defend against that vigorously.
